The Private Life rules allow individuals in the UK to apply for residence based on their long or continuous stay in the UK. The categories under Private Life Rules are:
1. Children (under 18)
– Must have lived continuously in the UK for at least 7 years
– It must be unreasonable to expect them to leave the UK
- Young Adults (18-24)
-Must have spent at least half their life continuously in the UK
- Adults (18+) – The “20-Year Rule“
– Must have 20 years of continuous residence in the UK (lawful or unlawful)
– “Continuous” means no major breaks, e.g. a single absence over 6 months, or total absences exceeding 550 days
- Less Than 20 Years: “Very Significant Obstacles” Route
If you do not meet the 20-year rule, you may still qualify if leaving the UK would create very significant obstacles to your integration.
Successful applicants typically receive limited leave to remain for 30 months. After 10 years’ lawful residence under this leave, you can apply for Indefinite Leave to Remain (ILR)
For these applications to succeed you need to gather strong evidence of residence (school records, medical records, tenancy agreements, etc.). If you are under one of these categories, you could regularise your immigration status in the UK. Please contact us if you think you qualify under the Private Life Rules.
